Successful litigation, in large part, depends on the specific facts of the case, the type of case, the parties, opposing counsel, dedication of your lawyer and most importantly you. You must be motivated and willing to work on your own behalf. It is imperative that you review the documents that are produced by the other side that you spend the time to respond to the discovery that has been issued to you and that you agree to spend the time necessary to prepare for your deposition. At the same time, you must not be out for blood as opposed to "righting" a wrong.
Your case, as all cases do, may have one specific area of the law that dominates the case but it will also have overlapping issues from other areas of the law. Your lawyer should have strong experience in numerous areas of the law and how the different areas of the law relate to each other. You and your lawyer must communicate about these issues and you must agree to cooperate with your lawyer.
In my office, great care is taken in the acceptance process. Each case presented to this office is not accepted just as every client is not accepted. What is Litigation?
In those few cases that cannot be resolved between the parties and by formal
mediation, litigation is the viable alternative. Litigation is not for the
faint hearted. A litigator must have the ability to conduct discovery,
prepare and attend depositions, research and brief the issues and the trial
experience to present your case to a jury or judge. This takes long hours
and dedication. This office is prepared and experienced to litigate your
case through these various stages.
My philosophy of aggressive case management is a key factor in our office's success. But, always remember that this is your case.
